Trump Fights Back: Restraining Order Filed In Harassment Lawsuit

The president is not some spineless politician without the balls to fight democrat plots to destroy him, his lawyers have filed a lawsuit against House democrats for their wanton partisan attacks and a restraining order against Elijah Cummings, the instigator.

Democrats are desperate. They know they can’t win against President Trump, so they are resorting to the worst sort of government waste and partisan harassment.

So, the president (as a private citizen) is taking the street fight to them. It’s not going to be pretty.

His lawyers have filed a lawsuit arguing that a House subpoena to his accounting firm Mazars USA is unlawful and should be blocked. They have also filed for a temporary restraining order against Elijah Cummings, chairman of the House Oversight Committee.

Lawyers argue the probe of President Trump’s private citizen finances have “no legislative purpose.”

“Democrats are using their new control of congressional committees to investigate every aspect of President Trump’s personal finances, businesses, and even his family,” says the filing in federal court in Washington, DC.

“Instead of working with the President to pass bipartisan legislation that would actually benefit Americans, House Democrats are singularly obsessed with finding something they can use to damage the President politically.”

Cummings claimed the accounting firm requested a subpoena before it would turn over the Trump financial information.

“They have told us that they will provide the information pretty much when they have a subpoena,” Cummings said at the time. “And we’ll get them a subpoena.”

In his March 20 letter, Cummings cited testimony from convicted liar Michael Cohen, who made claims about the president’s former business practices.

Slamming Cohen as a “felon who has pleaded guilty to lying to Congress,” the Trump filing says Cummings is on a political fishing expedition because his action “lacks a legitimate legislative purpose.”

“There is no possible legislation at the end of this tunnel; indeed, the Chairman does not claim otherwise,” the court papers say. “Its goal is to expose Plaintiffs’ private financial information for the sake of exposure, with the hope that it will turn up something that Democrats can use as a political tool against the President now and in the 2020 election.”

Jay Sekulow, one of Trump’s lawyers, said in a statement Monday that “we will not allow presidential harassment to go unanswered.”

Conservative Treehouse reported on the restraining order with their usual clarity, cutting through to the real purpose:

Donald Trump, not President Trump, representing his affiliated private business interests, has filed for a temporary restraining order (full pdf below) against House Oversight Committee Chairman Elijah Cummings and his committee representatives and officers.

You might remember when Speaker Nancy Pelosi changed the House Rules earlier this year.

Part of the rule changes were to modify the responsibilities of the House Government Affairs Oversight Committee.

Speaker Pelosi removed all other oversight responsibility and shifted the committee to a singular oversight role focused only on the White House.

Chairman Cummings is demanding the personal financial records of Donald Trump and all of his business interests around the Trump organization.

The demand includes all personal and private financial records including tax filings from individuals, officers and corporate entities within the Trump organization.

As a private, non-public corporation, this demand for financial records would encompass the entire Trump family.

In essence, Chairman Cummings is weaponizing his government office to target Donald Trump and all members of the Trump family.

This is not dissimilar to what President Obama and Elijah Cummings did when they weaponized the IRS to target their political opponents.  See: national heroine/patriot Catherine Engelbrecht.

When the IRS scheme was made public in 2011, the Obama plan shifted to use the intelligence operations of the U.S. Government to target their political opposition through the use of electronic surveillance and spy operations. Hence, this is one consistent continuum.

Chairman Cummings in 2019 is just a new iteration of the program.

Trump, not President Trump, has filed for a preliminary injunction to stop Chairman Cummings demand.

In the interim, while awaiting court arguments, Donald Trump and his business interests have filed for a restraining order.

So, thanks Obama, for showing brainless democrats the way to enact more government abuse of power.
