President Obama’s gender neutrality idealism and the progressive social engineering has has forced upon the American people for eight years is finally coming to an end.
A federal district court judge has ruled against Obama’s self redefining of gender and “sex” identification. The ruling puts a nationwide injunction on all new rules and regulations forcing all businesses, agencies and schools to recognize transgenderism. It also reverses Obamacare’s mandatory abortion coverage.
According to a CNN report, the new regulations were to take effect on Jan. 1. However, US District Judge Reed O’Connor stopped those protections from going into effect by ruling in favor of a Texas lawsuit filed by Attorney General Ken Paxton.
“Plaintiffs claim the Rule’s interpretation of sex discrimination pressures doctors to deliver healthcare in a manner that violates their religious freedom and thwarts their independent medical judgment and will require burdensome changes to their health insurance plans on January 1, 2017,” O’Connor wrote.
He added, “Plaintiffs argue the new regulation will require them to perform and provide insurance coverage for gender transitions and abortions, regardless of their contrary religious beliefs or medical judgment.”
O’Connor drew a conclusion that the regulations under Obamacare violated the Administrative Procedure Act enacted in 1946. One of the most important statutes in US administrative law, it was passed to insure federal regulations do not infringe on the individual rights of American citizens.
The APA was created during Franklin Roosevelt’s Marxist-leaning New Deal administration that expanded the federal government powers by adding new “agencies” and regulating thru those “agencies.” The federal statute applies to both federal executive departments and “independent agencies.”
AG Paxton filed the lawsuit on the premise that when Congress passed Obamacare, the word “sex” was used in the biological sense based on anatomy. On Sunday Paxton released the following statement:
“The Obama administration is attempting to redefine the law so that the term ‘sex’ means one’s ‘internal sense of gender which may be male, female, neither, or a combination of male and female,’ even though the president lacks the authority to rewrite the law.”
When originally passed by Congress by the narrowest of margins, Obamacare was already an enormous stand-alone piece of legislation at 2,000 pages. Since, Obama and his “agencies” have added to the law growing it to over 30,000 pages of rules and regulations, all without the scrutiny or approval of Congress.
Obama consistently exceeds the limitations placed on presidential powers under the Constitution. He has usurped the authority of the legislative branch of Congress, which represent ALL the people, not the less than one percent of the population the idealism of sex is a “state of mind” may affect.
Paxton saw the APA violation and filed suit on behalf of the Employees Retirement System of Texas. Obama’s redefinition of gender will force the retirement system to “amend its insurance coverage terms to provide for the reassignment surgeries and abortions. There are about 500,000 employees in the state with the coverage.”
The Texas AG maintains the new rule is designed to force medical professionals into performing abortions and sex reassignment services even if its against their religious beliefs and their own professional medical judgment.
“This runs roughshod over laws in Texas and other states that protect the independent medical judgment of doctors, which ensures the integrity of the doctor-patient relationship,” Paxton argued.
Though not widely reported by the Progressive owned Main Stream Media a former head at Johns Hopkins renounced Obama’s social engineering idealism.
Dr. Paul R. McHugh, the former psychiatrist-in-chief for Johns Hopkins Hospital and its current Distinguished Service Professor of Psychiatry, said that transgenderism is a “mental disorder” that merits treatment, that sex change is “biologically impossible,” and that people who promote sexual reassignment surgery are collaborating with and promoting a mental disorder.
Dr. McHugh’s professional opinion is significant for two reasons:
First, Johns Hopkins did the first sex reassignment surgery in the country and stopped performing those surgeries based on years of studies showing it did not end an individuals’ issues once the gender change is completed.
Second, Dr. McHugh’s personal research in the field as a renown and respected psychiatrist; McHugh cites the tragically high suicide rate among those patients who have undergone surgery and likens “transgender disorder” to that of one who suffers from anorexia and a mentally distorted view of self.
The transgendered person’s disorder is an “assumption” that they are different than the physical reality of their body, their maleness or femaleness, as assigned by nature. It is a disorder similar to a “dangerously thin” person suffering anorexia who looks in the mirror and thinks they are “overweight,” said McHugh.
Dr. McHugh further noted studies from Vanderbilt University and London’s Portman Clinic of children who had expressed transgender feelings but for whom, over time, 70%-80% “spontaneously lost those feelings.”
As O’Connor’s ruling will also have far reaching consequences for Obama’s dangerous policies such as bathroom choice. The Progressive left’s “anointed one” is forcing all government agencies, businesses and schools to open the bathroom door to any pervert or pedophile to march unchallenged into any women’s bathroom or locker room placing the most vulnerable in danger, our children.
North Carolina challenged the president’s illegal rules, by passing legislation that states individuals have to use the bathroom of the gender in which they were assigned at birth. In other words, if your a man you must use the men’s restroom and likewise women will use a women’s restroom.
The Tar Heel state has been blasted by those in the less one percent population and sympathizers whom they have guilted into supporting their agenda. That agenda being driven by the Progressive movement to destroy the social and economical foundation and structure of the United States; a plan to ensure their vision of the George Soros One World Order government is fulfilled.
North Carolina has not backed down from its stance even though the state has been hit from every side including economic boycotting. Meeting in a special legislative session on Dec. 21, rejected the bill’s repeal. O’Connor’s ruling will help to bolster North Carolina’s stand that the president does not have the authority to dictate or usurp the states’ authority to decide social matters.
President-elect Trump will be taking on many of Obama’s progressive policies including Obamacare when he takes his oath on Jan. 1. A new agenda is coming, one of the people and for the people… ALL PEOPLE.
