Clinton-Appointed Judge Overruled, Appeals Court Green Lights $3.6 Billion For Wall

This is yet another win, since the appeals court based its decision on a Supreme Court ruling, effectively forcing the Clinton-appointed judge to follow the rule of law.

This is a major win for America.

Clinton-appointed Judge David Briones of the Federal District Court in El Paso, ruled in December that the Trump administration’s declaration of a national emergency at the southern border was unlawful, and therefore, the $3.6 billion in military funds being used to construct the border barrier was blocked.

Of course, the leftist groups that brought the lawsuit chose their venue carefully, which allowed a single judge to dictate policy for the entire country.

Although the founders did not intend to give that sort of power to a district judge, liberal appointees have been using their power to essentially control nation-wide policy.

Thankfully, the Fifth Circuit Court of Appeals followed the precedent established by the Supreme Court, and overruled the previous decision. In fact, they intimated that the groups don’t even have the standing to sue the Trump administration!

In a 2-1 ruling, the panel noted that the U.S. Supreme Court had stayed an injunction in a similar border wall case from the 9th U.S. Circuit Court of Appeals.

The court also said there was a “substantial likelihood” that the parties challenging the funding transfer – the county of El Paso, Texas, and the Border Network for Human Rights – lacked standing to sue the Trump administration.

So far, and amid dogged resistance by Democratic legislators, Trump’s deputies have upgraded roughly 100 miles of older wall. The extra money — which was transferred from other spending programs by President Donald Trump’s emergency declaration — will allow the agencies to construct another 174 miles of wall, including new wall on stretches of the border which lack any barrier.

“The Fifth Circuit’s order allowing the Trump administration to proceed came in a brief 2-1 decision, with appointees of Presidents Reagan and Trump in the majority, and an Obama appointee in dissent,” says a report in the Wall Street Journal. “The order wasn’t a final ruling on the merits of the case, but gives the administration a green light for now.”

If anyone doubts the impact of the 2016 election, the proof is in the courts. Since President Trump was elected, numerous ‘injunctions’ have been granted in leftist-financed lawsuits, effectively blocking his power as the executive leader of the United States. Rather than allowing liberal controllers to enact their nation-wide policies through a single biased decision, many people argue, thanks to the appointments President Trump has made, higher courts are reigning in the prejudiced rulings.

Others argue that something must be done in the future to stop this sort of manipulation that essentially holds the nation hostage based on one, unelected person’s beliefs.
