Chuck Schumer Demands ‘Biden Rule’ Against Trump’s SCOTUS Nominee

Schumer claims the 'Biden Rule' forbids Republicans from nominating a Supreme Court justice during election year.

Schumer argues the Biden rule should prevent Republicans from nominating SCOTUS justice.

Senate Minority Leader Chuck Schumer is pulling out all of the stops in an effort to block Senate Republicans from nominating President Donald Trump‘s choice to replace Supreme Court Justice Anthony Kennedy prior to the midterm election.

As noted by Fox News Insider, Schumer is not only invoking the “Biden Rule,” he also claims any nominee who would seek to overturn Roe v. Wade should be rejected. During his speech Wednesday on the Senate floor, Schumer admitted that conservatives want to overturn the historic Supreme Court ruling legalizing abortion nationwide, and he’s trying to prevent Republicans from making that happen.

“[R]eproductive rights for women and countless other protections for middle-class Americans are at stake,” Schumer decried.

“The Senate should reject on a bipartisan basis any justice who would overturn Roe v. Wade,” he added, saying none of the 25 names on Trump’s list should be considered.

That alone illustrates how tone deaf, arrogant, and biased Schumer and the Democrats are. Without holding a single hearing or speaking with any of the potential nominees, they are outright rejecting 25 of Trump’s proposed picks.

Schumer demanded that Senate Majority Mitch McConnell abides by the so-called “Biden Rule,” which is named after former Vice President Joe Biden.

In 1992, then Sen. Biden gave a speech on the Senate floor urging Congress to delay hearings for any potential Supreme Court nominee until after the presidential election between former Presidents George H.W. Bush and Bill Clinton.

Biden knew that Clinton was favored to win the presidency, so he wanted the Democrats to be able to pick the Supreme Court nominee. There were no vacancies, but it became an unofficial political tactic used by the party that wasn’t in power.

The importance of the “Biden Rule” is that it pertained to presidential elections, not midterms.

McConnell cited the rule in 2016 to block Merrick Garland, former President Barack Obama‘s pick, because he wanted the winner of the presidential election to determine the judge. Trump won, so he nominated Neil Gorsuch.

Now, with Kennedy retiring, Democrats are hyperventilating that Trump will appoint another Gorsuch-type judge, a textualist who believes in individual and religious freedoms, and that the constitution is a legal document, not to be interpreted by the winds of popular opinion.

Trump has also favored pro-life candidates, leading liberals to fear that Republicans will overturn Roe v. Wade, which made abortion legal across the country.

Democrats screeching that Trump is going to appoint a pro-life judge to serve on the high court is actually a big boost for Republicans, as Evangelicals and many voters don’t believe taxpayers should be stuck footing the bill for abortions. However, many conservatives believe that they should be ‘shrewd as serpents’ when dealing with this issue. Rather than immediately advocating for its overturn, like liberals do with gun bans, conservatives should call such accusations outrageous.

The Left can foment and spread as many lies as they want, when Trump nominates another judge soon, they will be confirmed by the Republican-controlled Senate and it will give conservatives a 5-4 majority.

Elections have consequences, and the people voted for Trump because he promised to fill the high court with pro-life, conservatives.
